Criminal Defense News: N.J.S.A. 2B:12-31 to be Repealed

New Jersey municipal courts no longer have the authority to issue driver license suspensions for a failure to appear on a non-parking violation. 

This change goes into effect on January 1, 2021 and will remain in effect pending amendments to the court rules.  On the same day, Jan. 1, 2021,  N.J.S.A. 2B:12-31 (Suspension of driving privileges) will be repealed.

In accordance with the full order signed by Chief Justice Rabner, the Supreme Court relaxed & supplemented Rule 7:8-9(b) (“Driving Privileges; Report to Motor Vehicle Commission”).  A link to the full order here: https://gardenstatecle.com/pdf/12142020Notice.pdf
