Directive #23-06 issued by the New Jersey Supreme Court announced the implementation of a pilot program for conducting virtual jury trials due to the COVID-19 pandemic. While all civil trials were permitted to proceed virtually, for cases involving the impaneling of a grand-jury had not yet been addressed. Under the new program, criminal grand jury trials are permitted to proceed under the pilot program in Bergen and Mercer Counties.
This program draws equal amounts of praise and concern. The latter of which stems from the Constitutional issues to be raised by not having a physical jury present during the proceeding, especially in criminal matters.
