COVID-19 Relief Law - Bankruptcy Practitioner News
The CARES Act Sections 4022 and 4023 allow borrowers experiencing financial hardship directly or indirectly due to the COVID-19 emergency to request a forbearance on their mortgages. Effective May 11, 2020, a new bankruptcy event, Notice of Mortgage Forbearance, was specifically created to docket this event. Bankruptcy law practitioners will now have a new option for docketing cases specifically qualifying under Sections 4022 and 4023 for streamlined resolution.
The docket entry will be reflected on the Claims Register when linked to a proof of claim already on the Claims Register. The docket entry will not appear on the case docket. It will only appear on the Claims Register and on the case docket when a proof of claim has not been filed.
