Did You Know You Have the Right to Adjourn Your Sheriff's Sale for 28 Days?

If all else fails and you get a notice a Sheriff's Sale is scheduled, you aren't getting kicked out of your house on the date of the Sheriff's Sale.

But, if you do nothing, you will lose the property and it will be deeded back to the bank or sold at auction.  At that point, the eviction process will begin.

If you are facing a Sheriff's Sale, you may want to buy some time by taking advantage of your statutory right to adjourn for 28 days. N.J.S.A. 2A:17-36.

In order to exercise your adjournment rights, you should have a check for $28 ready for each of your statutory stays.

Further adjournments are possible if you can articulate a resonable basis and if you pay rent in the interim.

That statute states pertinently:

“2A:17-36.  Adjournments of sale of real estate.  A sheriff or other selling real estate by virtue of an exeuction may make two adjournments of the sale, and no more, at any time, not exceeding 14 calender days for each adjournment.  However, a court of competent jurisdiction may, for cause, order further adjournments.”
